Freehold vs Leasehold Land Maharashtra is decided by 3 holder classes under Section 29 of the Maharashtra Land Revenue Code, 1966, not by market labels. Occupant Class 1 is the freehold equivalent: the holder can sell, gift or mortgage it without government permission. Occupant Class 2 is permanent ownership with a restriction, since every transfer needs the Collector’s prior sanction. A Government lessee holds state land for a fixed term on lease rent and set conditions. Class 2 and leased land can move to Class 1 on a premium, with lower rates open until 31 December 2026.
Difference Between Freehold and Leasehold Land in Maharashtra
| Point | Occupant Class 1 (freehold) | Occupant Class 2 | Government lessee (leasehold) |
|---|---|---|---|
| Length of holding | Permanent | Permanent | Fixed term in the lease |
| Sale or gift | Free to transfer | Collector’s prior sanction | As the lease deed allows |
| Mortgage | Free to mortgage | Collector’s prior sanction | As the lease deed allows |
| Change of use | Planning rules only | Prior sanction and premium | Limited to the leased purpose |
The difference between freehold and leasehold land becomes especially important when comparing ownership rights under Freehold vs Leasehold Land Maharashtra rules. A Class 2 land sale made without the required sanction may be invalid, mutation can be refused, and registration alone does not cure the defect, potentially exposing subsequent buyers to legal risks.
Class 1 and Class 2 Land in Maharashtra
Class 1 and Class 2 land in Maharashtra usually differ by origin. Class 2 entries trace back to land the state handed out on conditions, and these are the sources a plot buyer meets most often:
- Surplus land distributed under the Maharashtra Agricultural Lands (Ceiling on Holdings) Act, 1961 to landless families, ex-servicemen and weaker sections
- Land bought by tenants under the Maharashtra Tenancy and Agricultural Lands Act, 1948, where Section 43 restricts resale
- Watan and inam land re-granted to former holders after those tenures were abolished
- Tribal occupancies, where Section 36A adds a separate sanction for any transfer to a non-tribal buyer
Palghar has a large Scheduled Tribe population, and our guide to plot documents in Boisar explains how that sanction shows up in the land record.
Ceiling land has its own conversion track. On 22 April 2026, the state cabinet approved a restructured premium of 20% to 30% of the ready reckoner value to convert these holdings to Class 1, depending on whether the location is urban or rural and on past transfers. About 1.09 lakh landholders stand to benefit, and cases with a market value above ₹50 lakh need state government approval.
Class 2 to Class 1 Conversion in Maharashtra
Rules notified on 8 March 2019 set out the route for Class 2 to Class 1 conversion in Maharashtra, and the same route covers leasehold-to-freehold conversion for Government lessees. It has 4 steps:
- Apply to the District Collector of the district where the land lies.
- The Collector inspects the land for any breach of the grant or lease terms, and an unregularised breach leads to rejection by a reasoned order.
- The Collector issues a demand notice for the premium, worked out as a share of land value.
- On payment, the conversion order is passed and the 7/12 is corrected to Class 1.
The Class 2 land conversion premium for individual holdings is charged at 2 levels. The lower level applies to applications filed before the cut-off that an amendment notified on 30 April 2026 extended by 1 year:
- Class 2 residential land: 15% at the lower level and 60% after the cut-off
- Leasehold residential land: 25% and 75%
- Commercial or industrial land under either tenure: 50% and 60%
- Residential plot originally granted at full occupancy price without concession: a flat 10%
When the premium crosses ₹1 crore, the Collector cannot pass the order alone, and the file needs prior approval from the state government.
New NA Rules in Maharashtra and Land Tenure
The Maharashtra Land Revenue Code (Second Amendment) Act, 2025, which received assent on 31 December 2025, removed the separate Collector permission for non-agricultural use wherever the development plan or regional plan already allows that use. Development permission from the planning authority now counts as proof of conversion, and the revenue record is updated from it.
Conversion tax and the yearly NA assessment are gone. In their place is a one-time premium on market value:
- Land up to 1,000 sq.m.: 0.1%
- 1,001 to 4,000 sq.m.: 0.25%
- Above 4,000 sq.m.: 0.5%
The new NA rules in Maharashtra leave one thing untouched: a development permission does not change the occupancy class. A Class 2 plot with an approved building plan is still Class 2, so the tenure conversion remains a separate file. For the planning side of a purchase, see our note on property in Palghar for first-time buyers.
Land Tenure Checks Before Buying a Plot in Boisar
When our team opens a file for a plot in Boisar, the occupancy class on the 7/12 comes before the rate card. A Class 1 entry lets the price discussion start. A Class 2 entry or a lease means we add the conversion premium at today’s ready reckoner value to the asking price, and only then compare the plot with other options.
3 gaps send a file back to the seller: A Class 2 entry with no conversion order, a sale chain with no sanction order on record, and a lease deed without a clear purpose clause. Each one blocks a clean transfer to you, and the premium to fix it belongs in the same budget as the charges in our plot cost guide for Boisar.
“Price tells you what a plot costs today. Tenure tells you what it will cost you to sell it, build on it or borrow against it tomorrow.”

The Birla Estates layout for Birla Mrida Plots in Boisar, Palghar covers 68 acres, of which 56 acres are saleable, with 539 plots ranging from 1,200 to 9,000 sq.ft.
Its registration under MahaRERA number PP1240002552953 is relevant to tenure, because the Real Estate (Regulation and Development) Act, 2016 requires a promoter to declare legal title to the project land, with legally valid documents authenticating that title, before registration.

Freehold and Leasehold Land FAQs
Is freehold land better than leasehold land for a home plot?
For most home plots, yes, because freehold tenure gives you full control over resale, loans and inheritance with no lease clock running. Leasehold land can still suit you if the lease term is long, the purpose clause allows a house, and the rent formula is clear. Read all 3 clauses in the lease deed before you compare prices.
What does Bhogvatadar Varg 2 mean on a 7/12 extract?
Bhogvatadar Varg 2 is the Marathi record entry for Occupant Class 2. It tells you the holder owns the land permanently but cannot transfer it freely. Bhogvatadar Varg 1 means Occupant Class 1, the freehold equivalent. You can view the 7/12 for any survey number on the state’s online land records by choosing the district, taluka, and village.
Is MIDC land in Tarapur freehold or leasehold?
MIDC industrial plots, including those in Tarapur near Boisar, are leasehold. The corporation stays the lessor, so selling or transferring a plot needs its prior written permission and payment of a transfer charge. MIDC leasehold land is therefore a different product from a residential plot held as Occupant Class 1 in a private layout.
Can leasehold land in Maharashtra be inherited?
Usually, yes. A government lease is generally inheritable, so the remaining term passes to your legal heirs along with its conditions. The lease deed can say otherwise, which makes the inheritance clause worth reading. Occupant Class 1 and Class 2 holdings are also heritable, so tenure decides how freely heirs can sell, not whether they inherit.
How is the Class 2 land conversion premium calculated?
You pay a percentage of the land value from the Annual Statement of Rates (the ready reckoner), published under the Maharashtra Stamp (Determination of True Market Value of Property) Rules, 1995. Where no rate is published for an area, the district’s Assistant Director of Town Planning fixes the value. The percentage depends on land category and filing date.
How long does Class 2 to Class 1 conversion take?
A state circular issued in August 2025 asks District Collectors to decide a complete application within 3 months of receiving it. Once you get the demand notice, you also have 3 months to pay the premium. If you miss that payment window, the land can stay in, or revert to, Class 2, so keep the funds ready.
Can forest land be converted from Class 2 to Class 1?
No. Land that is forest land or notified as a forest area is outside the conversion scheme, because its records are held in Forest Department registers rather than ordinary revenue records. If a 7/12 or any other paper links a plot you are considering to forest land, you cannot use the Class 2 to Class 1 route for it.
When is possession at Birla Mrida Boisar, and what does entry cost?
Possession is planned for 2028 to 2029, with a 30:70 payment plan and a booking amount of ₹1 Lakh. For the entry plot size, the Birla Mrida plot price starts at ₹55 Lakhs, before GST, stamp duty, and registration. Prices for larger plots are shared on request through the project
